Las donaciones de inmuebles vuelven a ser viables en Argentina

Hasta ahora, si bien se podían hacer donaciones de propiedades, estas quedaban con un título que podría ser observable, lo cual imposibilitaba la operatoria.

La Cámara Baja votó por unanimidad los cambios de cuatro artículos del Código Civil y Comercial que ya tenían previa sanción del Senado. Esto traerá un impacto muy favorable  en el mercado inmobiliario. Muchos padres ahora podrán dejar su legado material en vida, evitando así los costos más altos de una futura sucesión de bienes.

Beneficios del cambio en los artículos 2386, 2457, 2459 y 2459 del Código Civil y Comercial:

  •  Todo aquel que necesite hacer una donación de un inmueble, ahora la puede hacer, siendo un título ya no observable”
  • Donar un inmueble podía llegar a terminar en un conflicto, porque durante 10 años el inmueble quedaba observable, es decir, por ejemplo podía venir un hijo no reconocido y pedir su parte del bien, e ir directamente sobre el inmueble. Con este cambio, si ese bien ya fue vendido, no se le puede reclamar al actual poseedor.
  • El reclamo sobre un propiedad donada recae sobre el que recibió la donación y este puede responder con el equivalente al valor en dinero.
  • Todos los herederos forzosos seguirán protegidos, ahora se utilizará la acción de colación en vez de la de reducción cuando haya un eventual damnificado, o sea que se podrá compensar en dinero ese ajuste, y que no se vaya por la totalidad de la cosa
  • En argentina es una costumbre muy arraigada que los padres donaran sus bienes en vida entre sus hijos, este cambio en el Código hace viable esta posibilidad.
  • Entrarán en el mercado inmobiliario numerosos inmuebles que estaban “retenidos” debido a que había que esperar 10 años para el perfeccionamiento del titulo.
  •  Se volverán a hacer donaciones, En la Argentina más del 50 % de los inmuebles tienen como antecedente un título de donación.
  • Estas viviendas ahora pueden ser adquiridas con créditos hipotecarios o procrear. 
  • La gente mayor, que quieren hacer la donación de la vivienda a sus hijos reservándose el usufructo lo podrán hacer sin perjudicar una futura venta del inmueble. los hijos pasarán directamente a ser propietarios evitando los altos costos de una sucesión.
  • Las donaciones son muy económicas, porque están exentas de impuestos de sellos ni pagan impuesto a la transferencia de inmuebles (ITI), pagan un monto fijo de inscripción y de aporte notarial.
